Welcome to Bingboard Consulting, LLC (“we”, “us”, “our”). These Terms of Use (“Terms”) govern your access to and use of our website located at bingboard-consulting-llc.webflow.io (the “Site”) and any services, products, events, or content offered by us through this Site.
By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.
1. Use of the Site
1.1 Eligibility. You must be at least 18 years old (or older if required in your jurisdiction) to use the Site. If you are under 18, you may use the Site only with involvement of a parent or legal guardian.
1.2 Permitted Use. You may use the Site and its content only for lawful purposes and in accordance with these Terms. You agree not to use the Site in ways that violate any laws, infringe intellectual property rights, introduce viruses/malware, or interfere with Site operations.
1.3 Account / Registration (if applicable). If account creation is required, you agree to provide accurate information, keep login credentials secure, and be responsible for all activities under your account.
2. Shipping and Handling
2.1 Carrier. All shipping and handling will be through the USPS unless otherwise specified.
2.2 Customer Responsibility. Customers are responsible for providing accurate shipping information. Additional charges will apply if shipments are mailed to an incorrect address due to erroneous information.
2.3 Processing Time. Orders will be processed within 10 to 15 business days (excluding weekends and holidays) after verification.
2.4 Freight Costs. Freight costs are calculated at the time of shipping once weight is confirmed. Estimates can be obtained through USPS. Rates vary based on parcel weight and shipping zone.
2.5 Liability. Bingboard Consulting, LLC is not liable for lost shipments. The customer is responsible for filing claims with USPS for misplaced, lost, or undelivered packages.
3. Payment Policy
3.1 Accepted Payment Methods. Payments must be made in U.S. currency. We accept Visa, MasterCard, checks, eChecks, and money orders.
3.2 Taxes. Sales tax will be added to all orders from Hawai‘i residents.
3.3 Pricing. Prices are subject to change without notice due to market fluctuations.
4. Returns, Cancellations, and Damages
4.1 Returns & Restocking Fee.
- If we are unable to ship to your country, a 20% restocking fee will apply.
- Unless we are at fault, returned merchandise is subject to a 20% restocking fee and freight charges.
- No returns are accepted after 30 days from shipment.
- Items must be returned in original packaging and good condition.
4.2 Damaged Merchandise.
- If a package arrives visibly damaged, you may refuse delivery.
- If damage is discovered after opening, notify us by email immediately. Save the original packing material for return.
5. Intellectual Property
All content on the Site, including text, graphics, logos, and images, is owned or licensed by Bingboard Consulting, LLC and protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our permission.
6. User Content & Conduct
If you submit content to the Site, you grant us a non-exclusive license to use it. You agree not to post unlawful, defamatory, infringing, or harmful content. We reserve the right to remove any content or suspend users who violate these Terms.
7. Privacy & Security
7.1 Privacy. Customer information will not be shared, forwarded, or sold to outside entities.
7.2 Right to Refuse Service. We reserve the right to refuse service to anyone, while adhering to federal and state anti-discrimination laws.
8. Disclaimers
8.1 General Disclaimer. The Site and all content, products, and services are provided “as is” without warranties of any kind, express or implied.
8.2 Ho’oponopono Disclaimer. No guarantee whatsoever is made by Bingboard Consulting, LLC, Kamaile Rafaelovich, its employees, independent contractors, volunteers, sponsors, or instructors that the system of stress release and self-identity known as Ho’oponopono (Self I-Dentity through Ho’oponopono®) will yield specific results or outcomes.
The Ho’oponopono process is a personal, direct experience between the individual, their own tri-une self, and Divinity. Each individual bears full responsibility for their application and results.
8.3 Limitation of Liability. To the fullest extent permitted by law, we are not liable for indirect, incidental, or consequential damages. Our total liability shall not exceed the amount paid for the relevant product or service.
9. Indemnification
You agree to indemnify and hold harmless Bingboard Consulting, LLC and its representatives against any claims, damages, or expenses arising from your use of the Site or violation of these Terms.
10. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Hawaii. Any disputes shall be resolved by binding arbitration in Honolulu, Hawaii, unless otherwise agreed, or in small claims court if applicable.
11. Changes to Terms
We may update or modify these Terms from time to time. Updated versions will be posted on the Site, with the revised effective date. Continued use of the Site constitutes acceptance of the new Terms.
12. Entire Agreement
These Terms, together with our posted Policies & Procedures and Privacy Policy, form the entire agreement between you and Bingboard Consulting, LLC.
